The Make Me Fabulous website is owned and operated by eFemme Inc. ("MMF", "the Company", "we" or "us"). We are committed to protecting the privacy of our users and customers. This Privacy Policy (“Privacy Policy”) is intended to inform users of our policies and procedures regarding the collection, use and disclosure of personally identifiable information received from users of this website at the domain www.mmfbeauty.com (the "Website") and all other products and services, including mobile applications, owned, controlled or offered by MMF, and all content offered as a part thereof (the “Services”).

By using or accessing the Services in any manner or opening an account or otherwise registering with MMF, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways.

Note that your use of our Services is at all times subject to the Terms of Use, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.

This Privacy Policy covers our treatment of personally identifiable information ("Personal Information" or "Personal Data") that we gather when you are accessing or using our Services, but not to the practices of companies, sole proprietorships, partnerships, individuals or any other organization, website or services we do not own or control, or people that we do not manage. We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our services, to allow you to set up a user account and profile, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below.

As noted in the Terms of Use, we do not knowingly collect or solicit personal information from anyone under the age of 13. If you are under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. We are constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on www.mmfbeauty.com or by sending you an email. Please note that if you have opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. What information do we collect?

When you visit our website we may collect the following information:

Personal Data:

We receive and store any information you knowingly provide to us. For example, through the registration process and/or through your account settings, we may collect Personal Information such as your name, email address, phone number, credit card number and third-party account credentials (for example, your log-in credentials for Twitter or other third party sites). If you provide your third-party account credentials to us or otherwise sign in to the Services through a third party site or service, you understand some content and/or information in those accounts (“Third Party Account Information”) may be transmitted into your account with us, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy; for example, Twitter or Tumblr. Certain information may be required to register with us or to take advantage of some of our features.

We may communicate with you if you have provided us the means to do so. For example, if you have given us your email address, we may send you promotional email offers on behalf of other businesses, or email you about your use of the Services. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services. We use cookies for tracking transactions and the user characteristics explained in detail throughout this Privacy Policy. We use cookies to:

    -   - Remember you when you visit this website to keep track of your browsing patterns and to build up a profile of how you and other users use the website.
    -   Make our website work as efficiently as possible.
    -  Facilitate transactions and administer services to you and to our partners.

If you choose, there are utilities available for purchase from independent software providers to install on your computer as well as tools/preferences you can choose through most web browsers to make website visits anonymous, but this may prevent you from taking advantage of some of our features.

We may also add third party cookies. Again, this Privacy Policy does not cover the use of cookies by any third parties, and we are not responsible for their privacy policies and practices.

For example, this aggregate data can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible.

Third Party Personal Data:

We also collect personal data from you, the user, about certain third party individuals, including but not limited to your clients. We use this personal data that we collect from you in order to provide and improve our services, facilitate communication between you and such third parties, and as otherwise set forth in this Privacy Policy and in our Terms of Service. You warrant to MMF that any personal data you provide us about any third party individuals was obtained by you with full consent from such third party, and that such third party has not communicated to you that they wish to opt out of receiving communication from MMF.

How can you access and correct your personal information?

Through your account settings or by contacting us, you may access, and, in some cases, edit or delete the following information you’ve provided to us:

    •  user profile information, including audio and/or videos you have uploaded to the site

The information you can view, update, and delete may change as the Services change.

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask us for a notice identifying the categories of Personal Information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. Use of Personal Data:

MMF uses the personal data you provide in a manner that is consistent with this Privacy Policy or with any applicable service-specific agreement. If you provide personal data for a certain reason, we may use the personal data in connection with the reason for which it was provided. For instance, we will use the personal data you input during the registration process to administer access to the Website. We may also use the client information you submit to send such clients emails or SMS messages when you take action via the Website to input them or at your direction via the Website. We may also contact your clients to tell them about products and services that you and other MMF professionals may offer and to further promote your business and the Service. We will give your clients the opportunity to opt out of receiving communications from MMF. MMF and its affiliates also use your and your clients' personal data and other personally non-identifiable information collected through the Website to help us improve the content and functionality of the Website, to better understand the users of our Website, and to improve our services.

Information that is no longer personally identifiable: We may anonymize your Personal Information so that you are not individually identified, and provide that information to our partners.

Aggregated Personal Data: In an ongoing effort to better understand our users, we might analyze the personal data that is provided to the Website in aggregate form. This aggregate information does not identify you or your clients personally. We may share this aggregate data with our affiliates, agents and business partners. We may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.

Advertisers: We allow advertisers and/or merchant partners (collectively, “Advertisers”) to choose the demographic information of users who will see their advertisements and/or promotional offers and you agree that we may provide any of the information we have collected from you in non-personally identifiable form to an Advertiser, in order for that Advertiser to select the appropriate audience for those advertisements and/or offers. For example, we might use the fact you are located in Toronto to show you ads or offers for Toronto businesses, but we will not tell such businesses who you are. Note that if an advertiser asks us to show an ad to a certain audience or audience segment and you respond to that ad, the advertiser may conclude that you fit the description of the audience they were trying to reach.

We may deliver a file to you through the Services (known as a “web beacon”) from an ad network. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Affiliated Businesses: In certain situations, businesses or third party websites we are affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us). . We may share information we collect, including personal information, with MMF-owned or affiliated businesses. Sharing information with our affiliates enables us to provide you with information about a variety of products and services that might interest you. All MMF companies comply with applicable privacy and security laws and, at a minimum, in any commercial e-mail they send to you, will give you the opportunity to choose not to receive such e-mail messages in the future.You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service.

Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Our authorized service providers are companies that perform certain services on our behalf. These services may include fulfilling orders, processing credit card payments, delivering packages, providing customer service and marketing assistance, performing business and sales analyses, supporting the Website functionality, and supporting contests, sweepstakes, surveys and other features we offer. These service providers may have access to your clients' or your personal information to the extent necessary to perform their functions, but we do not allow them to share or use any of your personal information for any other purpose. We may share your clients or your personal information with the merchants offering the products, services, promotions, contests and/or sweepstakes. We won't share your personal information with these businesses unless you choose to participate in their offer or program. When you choose to engage in a particular offer or program, you authorize us to share your email address and other information with the relevant merchant.

User Profiles and Submissions: Certain user profile information, including your name, location, and any video or image content that such user has uploaded to the Services, may be displayed to other users to facilitate user interaction within the Services or address your request for our services. Your account privacy settings may allow you to limit the other users who can see the Personal Information in your user profile and/or what information in your user profile is visible to others. Please remember that any content you upload to your public user profile, along with any Personal Information or content that you voluntarily disclose online in a manner other users can view (on comments, in messages and chat areas, etc.) becomes publicly available, and can be collected and used by anyone. Your user name may also be displayed to other users if and when you send messages or comments or upload audio or videos through the Services and other users can contact you through messages and comments.

Business Transfers: We may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that would be transferred. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Protection of MMF and Others: We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of our Company, our employees, our users, or others.

Customer Credit Card Information: MMF uses a third party to keep a protected copy of your credit card number. This billing data belongs to you and by utilizing the Service, you grant MMF a license to use this data to bill you for services rendered.

Other Situations: We also may disclose your clients' or your information in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

Third Party Web Websites:

This Privacy Policy applies only to this Website and not to any third-party sites.

Security:

We take precautions to ensure the security of your clients' and your personal information. However, we cannot guarantee that hackers or unauthorized personnel will not gain access to your personal information despite our efforts. You should note that in using the Website and our related services, this information will travel through third party infrastructures which are not under our control. We cannot protect, nor does this Privacy Policy apply to, any information that you transmit to other users of the Website. You should never transmit personal or identifying information to other users.

Opt-Out Policy:

If, at any time after registering, you change your mind about receiving information from us or about the use of information volunteered by you, please send us a request specifying your new choice. Please contact us as specified above. You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features.

You may be able to add, update, or delete information as explained above. When you update information, however, we may maintain a copy of the unrevised information in our records. You may request deletion of your account through your account manager or by emailing support@mmfbeauty.com. Some information may remain in our records after your deletion of such information from your account. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.
